Mallorca Mountains SL offers different categories of services:

1. Scheduled activities published in the events section of the website.

2. Unscheduled activities, available privately and exclusively, upon request.

3. Purchase of merchandise and other products advertised on the website.

As a general rule, only the scheduled activities published on the calendar (number 1) can be purchased directly through the web portal and its payment gateway.

Other activities and services must be expressly requested by contacting the company’s reservation center.

Mallorca Mountains SL does not offer:

– Complementary services.
– Service packages.
– Services typical of a travel agency (accommodation, transfers, etc.).

PRICES

All prices published for the activities on the website include:
– A certified professional guide.
– Full technical equipment.
– Accident insurance.
– Civil Liability insurance.
– VAT (Value Added Tax).

The prices published for the activities on the website do not include:
– Food, beverages, complementary services, or any unspecified concept.

Special prices and conditions are established for private and exclusive groups, upon request.

Special prices and conditions are established for the rental of equipment, depending on its characteristics.

DISCOUNTS APPLICABLE ONLY TO SCHEDULED ACTIVITIES

Special and non-cumulative discounts are established as follows:

– 10% for clients who book more than 1 scheduled activity.
– 15% for clients who book more than 2 scheduled activities.
– 20% for clients who book more than 3 scheduled activities.
– Special offers that the company may provide on special occasions.

REMINDER: Any discount applied, either as part of a promotion generated by the company or directly offered by the reservations department for the activities offered, will eliminate any right of the client to a refund, as the activity is considered “low cost,” and the general terms for cancellations and changes will not apply.

PURCHASE PROCESS

For each Activity and/or Course, you must first select one of the available dates and then the number of participants. If the dates or number of participants do not meet your needs, please contact us to see if we can adapt to your requirements.

After selecting the date and the number of participants, the final price will be displayed. If you agree with it, you should press the “ADD TO CART” button.

Once added to the cart, you will be redirected to the cart page, where you can:

– Edit the order.
– Apply a discount coupon (if you have one or if there is an active promotion).
– And, finalize the purchase.

After clicking finalize purchase, you will be sent to the CONFIRMATION page, where your personal details (Name, address, etc.) will be requested, a summary of the order will be displayed, and the available payment options described below will be shown.

Finally, you will need to accept the website’s terms and conditions and click the “PLACE ORDER” button. Then, depending on the selected payment method, you will either be directed to the payment gateway (for card/PayPal payments) or the order will be processed directly (for bank transfer or cash on delivery).

If the payment is processed correctly: You will be shown the order confirmation page, and you will also receive an email with the order details and a link to the contract, which you must print, complete, sign, and bring on the day of the activity.

If there was a problem during the payment process: You will be shown a page indicating that there was an issue, and you will be given the option to try again.

PAYMENT METHODS

A reservation will be confirmed only after the full payment of 100% of the total price in advance. No reservation will be considered confirmed if the payment process is not successfully completed, and Mallorca Mountains SL cannot guarantee the availability of spots in such cases.

*Special conditions are established for school groups, communions, and birthday parties (upon request).*

The accepted payment methods are:

– Bank transfer.
– Cash.
– PayPal.
– Bizum.

– Credit card.

In exceptional cases where there is an outstanding amount, it will be paid on the day of the activity. As a general rule, this payment will be made in cash, as many meeting points for activities do not have card payment terminals.

BOOKING CONFIRMATION

As proof of booking, the client will receive, via email, a Booking Confirmation issued by us, which does not necessarily need to be presented to participate in the contracted activity.

CANCELLATION POLICY

The company:

• Reserves the right to postpone, change, or cancel an activity, even at the last minute, if the sea or weather forecast does not allow the planned activity to be carried out with complete safety guarantees.
• Reserves the right to postpone, change, or cancel an activity if the minimum number of participants is not reached for the agreed-upon day, depending on the activity.
• Reserves the right to accept or reject a reservation request for any reason, including, but not limited to, unavailability of a reservation, an error in the price or description or image of the service, or any error in the purchase.
• Reserves the right to postpone, change, or cancel an activity due to the guide’s indisposition.
• Reserves the right to decide if a person cannot participate in the activity due to physical or technical difficulties. The guide will decide whether that person can continue or must return, with no refund available.
• Reserves the right to cancel the excursion, once it has begun, due to poor weather conditions, where a refund is not available.
• Reserves the right not to refund the reservation money in the event that the guide has to perform an urgent rescue.

Visitors will be informed as far in advance as possible in any of the above situations, and a backup/alternative plan will be offered whenever possible. In this case, if the company makes or proposes a change to another activity of lesser value than the initial one, the conditions of the initial activity will always prevail, and, of course, there will be no refunds from the company.

If the company cannot reach the client through any of the provided means (email and mobile phone) to inform them of a possible change on the day before the activity, the client will lose their reservation and the right to a refund.

If applicable, the refund of the contracted service will be made using the same payment method used during the purchase.

The client:

If the client cancels the previously contracted activity, the following refund conditions will apply:

– 75% of the total amount if the cancellation occurs at least 14 days in advance.
– 50% of the total amount if the cancellation occurs between 5 and 13 days before the activity.
– 25% of the total amount if the cancellation occurs more than 1 day in advance but less than 5 days.
– 0% of the total amount in case of no-show or cancellation within 24 hours prior to the activity.

It is the sole responsibility of the client to show up on the indicated day and time for the start of the activity. If the client is late or fails to attend for any reason, no refund will be considered.

Out of respect for other participants, the guide will not wait or delay the start of the activity under any circumstances.

CHANGE POLICY

The client may choose another activity if the initial activity is canceled due to bad weather, lack of participants, or the guide’s unavailability.

Changes to the activity requested more than 14 days in advance will not incur any cost to the client.

Changes to the activity requested less than 14 days in advance may incur additional costs for the client, up to 50% of the total amount.

If the company makes or proposes a change to another activity of lesser value than the initially proposed activity, the conditions of the initially booked activity will always prevail, and, of course, the company will not issue any refunds upon making the change.

In case the client rejects the new proposal, the cancellation conditions will apply, considering that the client has decided to cancel the activity. The reservation payment will be valid for 90 days, after which the client will lose the right to a refund.

WITHDRAWAL

In accordance with the provisions of article 103.I) of Royal Legislative Decree 1/2007 of November 16, approving the revised text of the General Law for the Defense of Consumers and Users, the client’s right to withdraw is excluded, apart from the advanced cancellations expressly detailed in this document.

To manage any type of cancellation of previously contracted services, the client must contact our Customer Service by email: reservas@mallorcamountains.com or by phone at 0034 623004384, during business hours, Monday to Friday (9:00 to 16:00).

GENERAL CONTRACTING CONDITIONS

Access, reproduction, and use of the Website’s services require prior acceptance of the Terms of Use in force at the time; Mallorca Mountains SL reserves the right to modify these Conditions as deemed appropriate, by publishing the new text on the Website.

It is the user’s responsibility to be aware of the Terms of Use before accessing the Website’s services; if you do not agree with them, we kindly ask you to refrain from using it.

OWNERSHIP

The Website is a work composed of various integrated and inseparable elements (text, illustrations, photographs, animated images, videos, computer programs, including the website’s HTML code, etc.), whose Intellectual Property belongs to Mallorca Mountains SL, except for those materials obtained under license from third parties.

Mallorca Mountains SL and his licensors retain Intellectual Property over the Website and its individual elements at all times, in all copies made (regardless of the medium they are incorporated into), granting only the rights of use described below. Any right not expressly granted is understood to be reserved.

In addition to the above, Mallorca Mountains SL is responsible for the selection, design of the structure, and layout of the Website’s content, as well as having taken the initiative and assumed the risk of making substantial investments aimed at obtaining, digitizing, and presenting it. Therefore, he is entitled to the protection granted by Article 12 and Title VIII of Book II of the Intellectual Property Law, as amended by Law 5/1998, and similar provisions.

Mallorca Mountains SL is also the sole owner of the design and graphic image of the Website, reserving the right to take any legal actions that may correspond against individuals who engage in imitation or unfair use of the same.

WEB CONTENT AND DOWNLOADS. PERMITTED AND PROHIBITED USES

The following is permitted:

– Browsing the Website, that is, accessing and viewing it on a device.
– Establishing links and hyperlinks to the Website from other pages or websites, as long as they do not harm the public image or brand of Mallorca Mountains SL, the Website, or any of the individuals and products referenced therein. APPLICABLE LAW AND JURISDICTION

The parties agree to submit, at their choice, for the resolution of conflicts and renouncing any other jurisdiction, to the courts and tribunals of the user’s domicile.
